I, Tom Kitt, Minister of State at the Department of Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 86 of the Trade Marks Act, 1996 ( No. 6 of 1996 ), as adapted by the Enterprise and Employment (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 305 of 1997 ) and the Enterprise, Trade and Employment (Delegation of Ministerial Functions)(No. 2) Order ( S.I. No. 330 of 1997 ) hereby make the following regulations: |

1. (1) These Regulations may be cited as the Trade Marks Act, 1996 (Residence of Trade Mark Agents) Regulations, 2000. |

(2) These Regulations shall come into operation on the 2nd day of February, 2000. |
||||||||||
2. In these Regulations “Agreement on the European Economic Area” means the Agreement on the European Economic Area, signed in Oporto on 2 May 1992, as adjusted by the Protocol signed in Brussels on 17 March 1993. |

3. Each of the states, other than the State, which are contracting parties to the Agreement on the European Economic Area is hereby prescribed for the purposes of section 86(1)(a) of the Trade Marks Act, 1996 (No. 6 of 1996) . |

These Regulations allow persons who reside in any of the states that are parties to the Agreement on the European Economic Area, and who fulfil all the conditions for registration, to be eligible to be registered trade mark agents. |
