I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 97/71/EC of 15 December, 19971, hereby make the following Regulations: |
||

1. (1) These Regulations may be cited as the European Communities (Pesticide Residues) (Products of Plant Origin, including Fruit and Vegetables) (Amendment) Regulations, 1998 and shall come into operation on the 1st day of April 1998. |
||
(2) The European Communities (Pesticide Residues) (Products of Plant Origin, including Fruit and Vegetables) Regulations, 1997 and these Regulations may be cited as the European Communities (Pesticide Residues) (Products of Plant Origin, including Fruit and Vegetables) Regulations, 1997 and 1998 and shall be construed together as one. |

2. In these Regulations-- |
||
"the Principal Regulations" means the European Communities (Pesticide Residues) (Products of Plant Origin, including Fruit and Vegetables) Regulations, 1997 ( S.I. No. 221 of 1997 ). |
||
3. The footnotes to Annex II in Part 2 of the First Schedule to the Principal Regulations are hereby replaced by the following: |
||
"(a) (b) (c) (d) Should levels not be adopted by 31 October 1998 for acephate, benomyl carbendazim thiophanate-methyl, bifenthrin, chlorothalonil, chlorpyrifos, chlorpyrifos-methyl, cypermethrin, deltramethrin, dichlorvos, dicofol [in respect of tea], fenitrothion, fenvalerate, glyphosate, imazalil, iprodione, malathion (sum of malathion and malaoxon expressed as malathion), maneb mancozeb metiram probineb zineb, methamidophos, monocrotophos, permethrin, phoxim, phosmet (sum of phosmet and phosmet oxon expressed as phosmet), procymidone, propargite, quinalphos and vinclozolin, by at the latest 1 July 2000 for benalaxyl, benfurocarb, carbofuran, carbosulfan, chlormequat, cyfluthrin, diazinon, dicofol, disulfoton, endosulfan, ethephon, fenarimol, fenbutatin oxide, furathiocarb, lambda-cyhalothrin, mecarbam, metalaxyl, phorate, propiconazole, propyzamide, propoxur, triazophos and triforine, and by 1 July 2000 for aldicarb, amitraz, methomyl thiodicarb, methidathion, pirimiphosmethyl and thiabendazole, the following maximum levels1 shall apply as indicated thereafter: |

EXPLANATORY NOTE. |
||
The Regulations amend existing Regulations fixing maximum residue limits (MRLs) for products of plant origin, including fruit and vegetables by extending the dates by which the open positions would be replaced with definite MRLs. |
