The Incorporated Law Society of Ireland in exercise of the powers conferred on them by sections 4, 5, 25 and 40 of the Solicitors Act, 1954 hereby make the following Regulations:-- |
||
1. On and after the date on which these Regulations shall come into operation Regulation number 26 (i) and (ii) of the Solicitors Acts, 1954 and 1960 (Apprenticeship and Education) Regulations, 1975 (hereafter referred to as the Principal Regulations) shall be deleted and the following Regulations shall be substituted therefor:-- |

26. (i) A person to whom paragraph 4 of the Second Schedule to the Act applies and who before becoming bound as an apprenticeship has complied with the requirement of such paragraph shall be exempted from the Preliminary Examination and at the discretion of the Committee may be exempted in whole or in part from the Final Examination--First Part. |
||
(ii) A practising Barrister-at-Law seeking admission under section 43 of the Act shall be exempt from passing the Final Examination--First Part. |
||
2. These Regulations shall come into operation on the 1st day of July 1981. |
||
3. These Regulations may be cited as the Solicitors Acts, 1954 and 1960 (Apprenticeship and Education) Regulations, 1981 and shall be read with the Principal Regulations ( S.I. No. 66 of 1975 ). |
||

EXPLANATORY NOTE. |

Paragraph 4 of the Second Schedule to the Solicitors' Act, 1954 (No. 36 of 1954) fixes the term to be served under indentures of apprenticeship at three years for a person who, having been called to the bar, has, before becoming bound, procured himself to be disbarred. Regulation 26 (i) of S.I. No. 66 of 1975 relates to such a person and exempts him from the Preliminary Examination and from the Final Examination--First Part. The new Regulation now substituted for Regulation 26 (i) makes provision for the exemption from the Final Examination--First Part being at the discretion of the Education Committee and for such exemptions being granted in whole or in part. |
