I, PATRICK COONEY, Minister for Justice, in exercise of the powers conferred on me by section 10 of the Criminal Justice (Legal Aid) Act, 1962 (No. 12 of 1962), and, in so far as these regulations are in relation to rates or scales of payment of fees, costs or expenses payable out of moneys provided by the Oireachtas pursuant to certificates for free legal aid, with the consent of the Minister for Finance, hereby make the following regulations : |

1. These Regulations may be cited as the Criminal Justice (Legal Aid) (Amendment) Regulations, 1977. |

2. (1) The fees (payable under the Criminal Justice (Legal Aid) Act, 1962 ) of a solicitor assigned in relation to any particular case pursuant to a certificate or certificates for free legal aid shall be the fees that, but for these Regulations, would have been payable to him pursuant to such certificate or certificates in relation to that case increased by an amount equal to 40% of the amount of the latter fees. |

(2) Paragraph (1) of this Regulation does not apply in relation to the fees to which Regulation 5 of the Criminal Justice (Legal Aid) (Amendment) Regulations, 1976 ( S.I. No. 234 of 1976 ), applies. |

The Minister for Finance hereby consents to the making of the foregoing Regulations in so far as they are in relation to rates or scales of payment of fees, costs or expenses. |

EXPLANATORY NOTE. |
||
These Regulations increase by 40% certain fees payable to solicitors in connection with the Legal Aid Scheme for persons of insufficient means in criminal cases. The Minister for Industry and Commerce has, under Section 2 (2) (a) of the Prices (Amendment) Act, 1972 , consented to the exercise by the Minister for Justice and Finance of their statutory powers to determine these fees. |
