1.(1) Any person who carries on a nursing home without being duly registered in respect thereof shall be guilty of an offence and shall be liable on summary conviction (a)for a first offence, to a fine not exceeding #50; (b)for a second or subsequent offence, to imprisonment for a term not exceeding three months or to a fine not exceeding #50, or to both. (2) An application for registration of a nursing home shall be made in writing in the prescribed form to the [Health and Social Services Board] and shall be accompanied by [such fee as may be prescribed]. (3) Subject as provided in this Part, the [Health and Social Services Board] shall, on the receipt of an application for registration of a nursing home, register the applicant in respect of the nursing home specified in the application and issue to him a certificate of registration.
