INDUSTRIAL ASSURANCE (NORTHERN IRELAND) ORDER 1979 - SECT 42



42.(1) Any collecting society which contravenes or fails to comply with

(a)any of the provisions of this Order or of any regulations made under
Article 49(1)(d) for the purposes of Article 21; or

(b)any directions given by the Commissioner under this Order;

(2) A collecting society shall not be guilty of an offence under paragraph (1)
by reason of its insuring in contravention of Schedule 3, paragraph 2, if it
is proved that, owing to any false representation on the part of the proposer,
the society did not know that the insurance was in contravention of that
paragraph.

(3) The maximum penalty which may be imposed on a collecting society for an
offence under paragraph (1) shall be a fine not exceeding #200.
